H-2A Temporary Agricultural Worker Visa

The H-2A visa allows U.S. agricultural employers to hire foreign workers for temporary or seasonal agricultural jobswhen there are not enough U.S. workers available.

Who Is the H-2A Visa For?

The H-2A visa is designed for:

  • Agricultural employers or farm labor contractors in the U.S.
  • Foreign workers seeking temporary agricultural employment

Common H-2A jobs include:

  • Crop harvesting and planting
  • Fruit and vegetable picking
  • Dairy and livestock work
  • Greenhouse and nursery work
  • Farm equipment operation

Key H-2A Visa Requirements

To qualify, the employer must demonstrate that:

  • The work is temporary or seasonal
  • There are not enough qualified U.S. workers available
  • Hiring foreign workers will not negatively affect wages or working conditions of U.S. workers
  • Workers will be employed full-time

Employer Responsibilities

Employers sponsoring H-2A workers must:

  • Obtain a temporary labor certification from the U.S. Department of Labor
  • Pay the required wage rate (Adverse Effect Wage Rate or prevailing wage)
  • Provide free housing that meets safety standards
  • Provide transportation to and from the worksite
  • Cover inbound travel and visa-related costs as required
  • Offer workers’ compensation insurance
  • Comply with all federal, state, and local labor laws

Worker Eligibility

Foreign workers must:

  • Be a citizen of an H-2A eligible country
  • Have a valid job offer from a U.S. employer
  • Intend to work temporarily and return home after the job ends
  • Meet any job-specific experience requirements

H-2A Visa Duration

  • Granted for the length of the agricultural job, up to 1 year
  • Can be extended in increments, up to a maximum of 3 years
  • Workers must depart the U.S. after reaching the maximum stay
