EB-3 Employment-Based Immigrant Visa (Green Card)

The EB-3 visa is a U.S. employment-based immigrant visa that allows foreign nationals to live and work permanently in the United States. It is commonly used by U.S. employers to hire international workers for skilled, professional, and other essential roles.

Unlike temporary work visas, the EB-3 visa leads directly to lawful permanent residency (a Green Card).


EB-3 Visa Categories

The EB-3 visa has three employment categories:

1. Skilled Workers

For individuals whose jobs require:

  • At least 2 years of training or work experience
  • A permanent, full-time job offer from a U.S. employer

Examples: technicians, chefs, electricians, IT specialists, healthcare support staff


2. Professionals

For individuals who:

  • Hold a U.S. bachelor’s degree or foreign equivalent
  • Are entering a job that requires that degree

Examples: teachers, accountants, engineers, business professionals


3. Other Workers (Unskilled Workers)

For jobs that:

  • Require less than 2 years of training or experience
  • Are permanent and full-time

Examples: caregivers, hospitality workers, warehouse workers, food processing employees


Key Requirements

To qualify for an EB-3 visa, applicants must have:

  • permanent, full-time job offer from a U.S. employer
  • An employer willing to sponsor the visa
  • labor certification (PERM) approved by the U.S. Department of Labor
  • Proof that no qualified U.S. workers are available for the position
  • The required education, training, or experience for the job

EB-3 Visa Process Overview

  1. Employer Recruitment & PERM Filing
    The employer proves there are no qualified U.S. workers available.
  2. Immigrant Petition (Form I-140)
    Filed by the employer with U.S. Citizenship and Immigration Services (USCIS).
  3. Visa Application or Adjustment of Status
    • Applicants outside the U.S. apply through a U.S. embassy or consulate
    • Applicants inside the U.S. may apply for adjustment of status
  4. Green Card Approval
    Once approved, the applicant becomes a lawful permanent resident.

Processing times vary based on:

  • Category (Skilled, Professional, or Other Worker)
  • Country of origin
  • Annual visa availability

On average, the EB-3 process may take 1.5 to 4+ years.
